Terms and Conditions of Service for
Scarborough BC Ltd t/a "Boro Cars"
1. Introduction
1.1. These Terms and Conditions govern the provision of private hire services by Scarborough BC Ltd trading as "Boro Cars" ("we," "our," or "us").
1.2. By booking and using our services, you ("the Customer" or "Passenger") agree to be bound by these terms.
1.3. Agency Role: Scarborough BC Ltd t/a "Boro Cars" acts as a booking agent for self-employed drivers who operate the vehicles. When you book a ride, your contract for the transportation service is directly with the driver. We facilitate the booking and act as an intermediary between you and the driver.
2. Service Provision
2.1. We provide private hire taxi services in the areas we operate, subject to availability.
2.2. All bookings are subject to vehicle and driver availability at the time of the request.
2.3. We reserve the right to refuse any booking request for reasons including but not limited to safety concerns, inappropriate behavior, or non-compliance with our policies.
3. Bookings
3.1. Bookings can be made via phone, mobile application, or through our online booking system.
3.2. It is the Customers responsibility to provide accurate information when making a booking (i.e., time, date, pickup and drop-off locations).
3.3. Booking confirmation will be provided via email, SMS, or in-app notification.
3.4. In the event of any changes to the booking (such as delays, amendments, or cancellations), it is the responsibility of the customer to inform us as soon as possible, charges maybe incurred.
4. Pricing and Payment
4.1. Fares are calculated based on distance from our base, travel time, and any additional services requested. All fares are quoted in GBP and may be subject to VAT at the standard rate where applicable.
4.2. An estimated fare will be provided at the time of booking. Final fare may vary based on traffic, route & toll changes, fouling charges, airport parking fees and waiting times.
4.3. Payment can be made by cash, credit/debit card, or other payment methods we accept.
4.4. All payments must be made in advance or at the end of the journey unless otherwise agreed.
4.5. Additional charges may apply for waiting times, extra stops, or if the journey deviates from the original booking.
4.6. Driver Remuneration: As we operate as agents for self-employed drivers, the fare paid by the Customer is directly paid to the driver, less any agreed commission to Scarborough BC Ltd for the facilitation of the booking service.
5. Cancellations and Amendments
5.1. Cancellations must be made at least 15 minutes in advance of the scheduled pick-up time to avoid cancellation fees.
5.2. A cancellation fee may be charged if the Customer cancels within 5 minutes or if the driver has already been dispatched or has arrived.
5.3. If the Customer fails to show up at the agreed pick-up location within 5 minutes of the requested time without prior notification, a "no-show" fees may apply.
5.4. Any changes to the booking should be communicated as soon as possible. We will make reasonable efforts to accommodate changes but do not guarantee that all amendments can be accepted.
6. Passenger Conduct
6.1. Passengers must act respectfully toward the driver and the vehicle at all times.
6.2. Smoking, drinking alcohol, and consuming food in the vehicle are prohibited unless explicitly agreed upon.
6.3. Any damage caused to the vehicle by the Passenger will result in charges for the repair or cleaning required.
6.4. The driver reserves the right to refuse to transport any Passenger who is deemed to pose a risk to the driver, other passengers, or the vehicle.
7. Luggage and Personal Items
7.1. The Customer is responsible for their own luggage and personal belongings.
7.2. We will not be liable for any loss or damage to personal items left in the vehicle after the journey is completed.
7.3. The driver has the right to refuse items that may cause damage to the vehicle or pose a safety hazard.
8. Delays and Liability
8.1. We strive to provide timely service; however, we are not responsible for delays caused by traffic, weather, or other circumstances beyond our control.
8.2. We will not be held liable for any direct or indirect losses, including missed flights, meetings, or events, due to delays.
8.3. We reserve the right to terminate a journey if it is unsafe to continue or if there is a serious breach of these terms by the Passenger.
8.4. As agents, our liability is limited to the extent of arranging the booking. The driver is responsible for the performance of the transport service.
8.5. Customers are given 5 minutes of free waiting time for all bookings from the point of the requested booking time, after which a charge of £1.00 per minute will apply. Airport arrival bookings, a 30-minute free waiting period is included after the requested booking time, after which a £25 per hour will be charged. It is the Customer’s responsibility to notify us in advance of any delays.
9. Complaints and Feedback
9.1. We value customer feedback. Any complaints or service issues should be reported to our customer service team within 48 hours of the incident.
9.2. We will make every effort to resolve complaints promptly and fairly.
9.3. Complaints about the conduct of the driver or service provided by the driver will be forwarded to the driver for resolution.
10. Data Protection
10.1. We collect and process personal data in accordance with applicable data protection laws.
10.2. Personal information collected during booking is used solely for providing our taxi services and will not be shared with third parties except as necessary for service provision or legal requirements.
11. Governing Law
11.1. These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
11.2. Any disputes arising from the provision of our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Amendments to Terms
12.1. We reserve the right to update or amend these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website or other communication channels.
12.2. By continuing to use our services after any updates, you agree to be bound by the revised terms.
